This webinar provides an introduction to the legal protection of research results under design law. This formal protection mechanism covers an impressive range of subject matter and is therefore of great importance to university researchers. These include, for example, consumer products, graphics, user interfaces, layouts, and buildings.
With a single application, you can obtain protection throughout the European Union at a very low cost through the EU design. The so-called unregistered EU design even provides protection without the need for an application and at no cost, simply through initial publication within the EU. Designs are very easy to defend in court, as the requirements for the criterion of distinctiveness are significantly less stringent than those for the individuality required under copyright law. The “distinctive character” of a design necessary for enforcement is generally recognized when compared to prior designs, provided, of course, that searches for earlier designs were conducted prior to filing the application. Registered designs can ultimately be exploited as a standalone or supplementary intellectual property right.
