Just as the creators themselves are diverse, the allocation of ownership and usage rights regarding university IP can vary significantly. It is important to note that some individuals hold a "dual role": they are employees subject to instructions while simultaneously acting as independent researchers within the scope of their theses. This situation presents several potential paths regarding rights allocation. Furthermore, distinct legal IP regulations apply to inventions, copyrights, software, designs, know-how, and data. Navigating this complex landscape requires clear guidance. Finally, regarding the ownership of physical materials, the concept of the "manufacturer" (or "maker") from civil law—a framework not originally designed for IP—also becomes relevant.

We explain the system of rights allocation and usage options concerning university IP, while keeping a close eye on practical realities and the challenges faced by universities. For instance, in our view, researcher participation in third-party funded projects allows for flexible assessment options and a highly pragmatic approach to handling rights.
